Acceptance of our Terms

These are the Terms and Conditions which apply when buying goods from shop.seafood-and-co.com. Please read this agreement carefully. This should be read in combination with the Privacy Policy. These represent the Terms and Conditions for using this service. If you do not agree to these, then you may not use this Website. You are permitted to use our Website solely on the basis of these Terms and Conditions. We reserve the right, at our discretion, to update and/or revise these Terms and Conditions. Please check periodically for changes. If you have any questions relating to these Terms and Conditions please contact us.

Terms and Conditions

  1. Use of the Website
    1. To register with shop.seafood-and-co.com and purchase goods from our Website you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order.
    2. We reserve the right to: Decline a new customer registration or suspend a customer’s account at any time and at our sole discretion. Seafood & Co. reserves the right, in our absolute discretion, to terminate your access to all or part of the services with or without notice.
  2. Availability
    1. Goods are subject to availability. If for any reason beyond our reasonable control we are unable to supply a particular item, we will not be liable to you except to ensure that you are not charged for that item. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
    2. Some items are only available to purchasers above a certain age. These are clearly marked.
  3. Bulk purchase
    1. To ensure availability of all our products, customers may be limited to a maximum number of items. Goods will not be supplied for the purposes of resale, and are only supplied for a customer’s own use as a consumer. We reserve the right to refuse orders that we consider are for commercial or non-domestic purposes or subject to onward delivery by a third party. Orders for more than 12 units of a single product line may be fulfilled subject to availability and at the discretion of the store. Quantities of goods supplied per order may be limited if the order limits availability for other customers or creates a potential health and safety issue for our drivers.
  4. Purchase for non-domestic use
    1. We have selected our products on the basis that they will be used for domestic use only. Where you decide to use the products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose.
  5. Pricing, descriptions and product information
    1. The prices which you must pay for the products that you order are set out on the Website at the time you place your order (plus a delivery charge). Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. If a product’s correct price is higher than the price stated on our site, we are under no obligation to supply the product to you at this price and will inform you as soon as possible to give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.
    2. The prices quoted on this Website apply only to products sold via this Website. Where the same products are available in our stores or via our Grocery Website different prices may apply.
    3. All prices are shown in US$ and exclude VAT.
    4. Although we will take all reasonable care to ensure that all descriptions, details and prices of products appearing on the Website are correct at the time when the information was inputted onto the system, the information appearing on this Website at any time may not reflect the exact position at the moment you place an order.
    5. Please be aware that the colors and appearance of our products may vary slightly from the way they appear on the screen and we cannot guarantee that your monitor screen will accurately reflect the color of the product on delivery. All weights and sizes are approximate, although we make every effort to ensure that they are as accurate as possible.
  6. Placing an order and order acceptance
    1. The Order Acknowledgement email and order number are not an order confirmation or order acceptance from us. Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it. Where items are dispatched separately, our acceptance of the order in respect of each item takes place when that item is dispatched. Our carrier will make every reasonable effort to contact you to make delivery, but if they are unable to do so then your order will be cancelled and payment refunded to you. Where you use our in-store pick-up service, acceptance of your order will take place when the goods are available for collection by you at your nominated collection store.
    2. We are not permitted to sell alcohol or age restricted products to any person under the age of 18.
  7. Payment
    1. Payment must be made with a valid credit, debit card or other means of payment acceptable to PayPal or via Direct Deposit on the bank account shown during Check-Out. The address at which the card  or bank account is registered must be the same as your billing address. You can register a new payment card at with PayPal any time, but the card associated with a given order cannot be changed once you have checked out.
    2. Seafood & Co.’s gift vouchers and gift cards may be exchanged for goods in our Website.
  8. Delivery
    1. We deliver to addresses within the Shanghai municipality. We cannot deliver to other locations outside Shanghai municipality.
    2. Provided that we have processed and received payment in full for the products, ownership of an item will pass to you once we have delivered the item to you (either directly, or by leaving it in a safe place or with a neighbor, or, where you have used our in-store pick-up service, when the goods are handed to you or your representative at our store location. When an item has been delivered, risk of damage to, or loss of, the item passes to you.
    3. By placing an order you are authorizing us to accept signature from another person at the same address on your behalf if you are not present at the time of delivery. We will not be able deliver large items to your premises unless there is someone present to accept them. Where you use our in-store pick-up service, you authorize us to deliver to any person in possession of your Order Acknowledgement and who provides suitable documentary evidence of their identity.
    4. Seafood & Co. will be under no liability for any delay or failure to deliver the products within estimated timescales. We exclude liability in contract or tort (except liability for death or personal injury caused by our negligence) for any loss, economic or otherwise incurred by or suffered by you in connection with any provisions included in these Conditions or by your use of our Website.
    5. It is your responsibility to ensure you check access to your premises and the space available for the product before placing your order.
    6. It is your responsibility to tell us about any special delivery requirements or access issues when we phone you to schedule your delivery.
    7. If you aren’t in for a scheduled delivery we reserve the right to charge you for storage, re-delivery or both.
    8. Where requested by the delivery driver, products must be inspected upon delivery and refused if any damage is found. Failure to notify us of any visible damage may result in claims not being accepted if the item has been signed for. Damage should be notified to the driver and noted on their delivery pad at the time of refusal.
    9. You must not fit or use a product that is damaged or different to that, which was ordered. Failure to comply with this will deem that you have accepted the goods and will be unable to return them because they are damaged or different to that ordered. Your statutory rights are not affected.
  9. Cancellation and refunds from Seafood & Co.
    1. As the nature of Seafood & Co.’s products is primarily that of perishable goods, the right to cancel orders is limited to 8 hours after initial order. The right to cancel an order is waived upon Seafood & Co.’s notice of processing of your order.
    2. Your right to return does not apply to products which fall into the following categories unless they are faulty: Goods made to your specification cannot be returned for any reason. In exceptional circumstances, we may agree to accept returns and we reserve the right to charge a cancellation fee of 20% of the purchase price. Perishable goods. Sealed items that have had the seal broken. Items which cannot be re-sold for health and hygiene reasons once unwrapped.
    3. All refunds will be made to the debit or credit card on which the original purchase was made within 30 days.
    4. Your statutory rights are not affected.
  10. E-vouchers and promotions
    1. Evouchers can only be used on this Website subject to these Terms and Conditions.
    2. Evouchers are, and remain at all times the property of Seafood & Co. The right to use an evoucher is personal to the original or named recipient and may not be transferred without permission. It may not be copied, reproduced or published either directly or indirectly. Evouchers distributed or circulated without our prior written approval are not valid and may be refused or cancelled. If you redeem or attempt to redeem an evoucher to which you are not entitled you may be committing an offence.
    3. Seafood & Co. reserves the right to cancel or withdraw any evoucher or promotion at any time without notice and without reason. If we refuse an evoucher for any reason we will inform you before the order is dispatched to give you the opportunity to cancel the order.
    4. Unless otherwise stated an evoucher may be used only by the named recipient, it may only be used as stated on the evoucher and not in conjunction with any other offer or evoucher. Evouchers cannot be exchanged for cash, gift vouchers, delivery charges (except where stated) or for a whole order.
    5. When an evoucher or other promotional offer applies to more than one product, the total value of the promotional offer or discount is split and shared across each applicable product in the correct ratio. If an item or part of the order is returned, then we will refund the relevant correct value.
  11. Privacy
    1. We may contact you by phone or by text about your order. Registration data and certain other information about you is subject to our Privacy Policy. We recommend that you read our Privacy Policy before you accept these Terms and Conditions.
  12. Intellectual property
    1. The content of the shop.seafood-and-co.com Website is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.   13. Limitations
    1. This Website and the Retail Sites and any software are provided on an “AS IS” basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

  1. Grocery registration and contract
    1. You are the customer. You agree to purchase services and goods from Seafood & Co. subject to these Terms and Conditions which will apply to all transactions using our grocery service.
    2. You must be 18 years or over and must complete the registration procedure to participate in our grocery service.
    3. By registering for this service you agree that the details provided by you on registration, or at any time, are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order.
    4. Your email address is essential in order for us to be able to supply you with important information such as order confirmations, and changes to the service. By registering with our grocery service, you accept that your email address may be used to supply you with such information.
    5. It is your responsibility to keep your password secure. We reserve the right to modify or withdraw a password at our discretion.
    6. We reserve the right to: Decline a new customer registration or suspend or terminate a customer’s account at any time and at our sole discretion. At our absolute discretion to terminate your access to all or part of this service with or without notice.
    7. We will not be responsible for any loss or damage caused to the goods after the contract has been concluded. Otherwise, our liability to you shall be limited in contract and/or tort to the value of the order only, unless we have been negligent and that negligence has caused death or personal injury.
  2. Grocery pricing and payment
    1. The prices shown on this Website at the time of ordering are guide prices. They are the in-store selling prices that day at the store at which your goods will be selected. The prices you will be charged for goods will be the actual prices displayed in that store on the day of delivery, including any promotional offers if applicable. You accept that prices of goods may, therefore, increase or decrease between the day of ordering and the day of delivery.
    2. The weight of some goods may vary marginally from that ordered and the price may change to reflect actual weight.
    3. Where applicable, prices include Value Added Tax. The prices on the website reflect the current rate of VAT and not necessarily the rate you will be charged on the day of your delivery.

  3. Supply of grocery goods ordered and alternative goods
    1. Goods will not be supplied for the purposes of resale, and are only supplied for your own use as a consumer. We reserve the right to refuse orders that we consider are for commercial or non-domestic purposes, or subject to onward delivery by a 3rd party.
    2. Food goods are supplied at the temperature appropriate to that food.
    3. Goods are subject to availability and prevailing market conditions, If any goods you wish to purchase are not available, Seafood & Co. will try to offer you ‘alternative goods’ similar to the goods you have requested, which may be a different price. Please note we will attempt to deliver substitute products should selected products be unavailable unless you request us not to do so.
    4. We will tell you which items have been substituted and with what.
  4. Ordering of multiple or bulky grocery items
    1. Orders for more than 12 units of a single product line may be fulfilled subject to availability and at the discretion of the store. Quantities of goods supplied per order may be limited if the order limits availability for other customers or creates a potential health and safety issue for our drivers. To ensure we have the greatest opportunity of fulfilling larger orders, please give us at least 10 days notice of your request.
    2. Due to concerns regarding the heath and safety of our delivery drivers, we reserve the right to limit orders of certain bulky items.
  5. Placing a grocery order
    1. Seafood & Co. reserves the right to amend delivery fees at any time without notice.
  6. Grocery free delivery offer
    1. Delivery times are subject to availability.
    2. Seafood & Co. reserves the right to withdraw its free delivery offer at any time.
  7. Grocery special offers, evouchers
    1. From time to time, we may provide you with evouchers, which may be redeemed by you against a first or subsequent order. Evouchers can be used only once, in accordance with the instructions detailed on the evoucher. Those instructions form part of the Terms and Conditions.
    2. Evouchers cannot be used in respect of goods to be delivered after the expiry date – see evoucher for expiry date. Evouchers cannot be exchanged for cash or used for cash back. Evouchers are non-transferable and can only be used with the grocery service.
    3. Evouchers can entitle you to either money off a particular product and/or in some cases a free product. The voucher will be made available to you via the website only and will state which product or products it applies to, the saving you may make, the evoucher code and the evoucher expiry date. Products are subject to availability while stocks last. If a product for which you have an evoucher is not available and we deliver a substitute the evoucher will automatically be applied to the substitute.
    4. Evouchers made available to you on the website will state an expiry date. To use the evoucher you must place an order and have it delivered by this date.
    5. Evouchers shown on Seafood & Co. can only be used on shop@seafood-and-co.com and may not be used on any other website. All evouchers are subject to these terms and conditions and any other specific conditions notified on the voucher or at the time of issue.
    6. Each evoucher code may be used once only per customer and/or once per delivery address. An evoucher may not be used in conjunction with any other special offer or evoucher, unless otherwise stated.
    7. Your use of an evoucher indicates your agreement to be bound by these terms and conditions.
    8. Seafood & Co. reserves the right to withdraw or terminate any evoucher at any time. Seafood & Co. reserves the right to refuse to accept the use of an evoucher if fraud is suspected.
  8. Amending or cancelling an grocery order
    1. Changes to your order may be made up until 8 hours after your order, but not after we have sent an Order Processing Confirmation to you.
    2. Should adverse weather conditions or any other event outside our reasonable control result in a later or cancelled delivery, we will contact you as soon as possible to re-schedule your delivery. All alternative delivery dates are subject to availability. Should you incur any loss as a direct result of such a delay our liability to you shall be limited to the value of the order only.
  9. Grocery delivery restrictions
    1. We will deliver to the address specified by you when you checkout your order.
    2. We reserve the right to restrict or refuse delivery requests in certain areas at any time and without notice.
    3. You or someone aged 18 or over on your behalf must be available to receive and inspect the delivery. Under no circumstances will goods be left unattended.
  10. Our grocery doorstep service
    1. We will always deliver your order to the front door of your house or to the communal entrance to your block of flats. Our drivers may also deliver beyond this into your home.
    2. Our delivery service does not include a detailed check of your shopping. However, if you have any queries, please contact us after your delivery has taken place.
    3. If your delivery is to a work address, we will always deliver to the ground floor communal entrance of your business’ building then contact you to meet our driver. We reserve the right to return your order to our store if you do not come to collect your order within a reasonable time. In this instance, we reserve the right to charge for any re-delivery.
  11.  Grocery re-delivery
    1. If you are out for the time of your scheduled delivery, or are unable to meet our driver in your workplace within a reasonable time, we reserve the right to return your order to our store and to charge RMB 200 for re-delivery.
    2. If you have not contacted us within 24 hours to rearrange a failed delivery, the order will be cancelled without any refund.
  12. Grocery returns
    1. Please note, it is not possible to return frozen or perishable food and drink unless they are of poor quality or faulty, or where we have delivered goods that you did not order and you have not accepted them. Products where the seal has been broken cannot be returned.

    1. We welcome feedback. Any customer comments should be addressed to us – you will find an email link or address and telephone numbers listed on our website in the “Contact Us” section.
  14. Grocery privacy and general provisions
    1. Your personal details may be used by Seafood & Co. for market research and statistical analysis. We would also like to contact you occasionally with details of products, services and special offers that may interest you. To do this we will look at the information provided by you and details of products you buy. If Seafood & Co. acquires or develops other businesses the data may be used by the new business in a similar way. By registering with our grocery service, you accept that your email address may be used to supply you with such information. Customers wishing to change this can inform us. Seafood & Co. will use your mobile phone number to send you a reminder of your grocery delivery slot time.
    2. These Terms and Conditions and the documents produced in accordance with it comprise the entire agreement between you and Seafood & Co. regarding each grocery order which concludes in a contract. The law of the People’s Republic of China is the governing law of each contract.
    3. Seafood & Co. reserves the right to alter or withdraw the grocery service at any time, to refuse the service to any customer and to amend these Terms and Conditions of this Website. If we make any changes to these terms, we will let you know as soon a possible by posting the changes on our Website and updating the date below.
